Section 93 ensures that proceedings conducted by the Authority for Advance Ruling (AAR) or the Appellate Authority for Advance Ruling (AAAR) remain valid even if there is any vacancy, defect, or irregularity in the constitution of the authority.
The law recognizes that administrative changes such as retirement, transfer, resignation, promotion, or replacement of members may occur during the functioning of these authorities. Such changes should not unnecessarily delay proceedings or invalidate decisions already taken.
Therefore, if any vacancy exists in the authority or there is a minor defect in the appointment of a member, the proceedings, hearings, and orders of the authority will generally remain valid, provided the defect does not materially affect the merits of the case.
