Section 94
What does this Section say?
Section 94 prescribes the procedure to be followed by the Authority for Advance Ruling while dealing with applications filed by taxpayers.
Upon receiving an application, the Authority forwards a copy to the concerned GST officer and calls for relevant records if necessary. Before admitting the application, the Authority verifies whether the question raised is already pending or decided in any proceeding involving the applicant. If the matter is already under consideration elsewhere, the application may be rejected.
The applicant must be given an opportunity of being heard before rejection. Once admitted, the Authority examines the facts, legal provisions, documents, and submissions made by both the applicant and the GST department.
The Authority has powers similar to those of a civil court for discovery of facts, inspection of records, summoning persons, and receiving evidence. It may conduct hearings and seek additional information before arriving at a conclusion.
After considering all relevant facts and legal provisions, the Authority pronounces its Advance Ruling in writing. The ruling is then communicated to the applicant and the concerned GST authorities.
The section ensures transparency, fairness, and natural justice by allowing both sides to present their arguments before a decision is taken.
Example
A taxpayer seeks clarification on whether a promotional incentive scheme qualifies as a taxable supply. The Authority examines contracts, invoices, and departmental views before issuing a ruling.
